- Harm which could occur must be reasonably foreseeable of which the defendants can conduct.
- A sufficient relationship of proximity or neighborhood exists between the alleged wrongdoer and the person who has suffered damage.
- It is fair, just and reasonable to impose liability.
There are 3 tests to apply to risks which are reasonably foreseeable.

- Industry Knowledge
- Expert Knowledge
Risk = Likelihood x consequence (To work out practicability)
